Kontras Submit Five Suggestions for Intelligence Bill

Theindonesiatoday.com - Anticipating deliberation of the controversial Intelligence Bill next week by The House of Representatives (DPR) Commission I, Coordinator of the Missing and Victims of Violence (Kontras), submits five suggestions to ensure the bill will reinforcing protection of human rights, Vivanews.com reported.

First, Intelligence Bill should ensure intelligence reform, especially related to organizing models, structuring the priorities of intelligence organization, the development of accountability mechanisms and institutions.

Second, intelligence can do the wiretapping /interception, but has to go through a standard mechanism and must have a clear prerequisite. Intelligence must obtain prior court approval and provide a very clear purpose, for example, tools to be used, period and specific cases to conduct any interception.

Third, intelligence is not allowed to conduct an intensive examination to anybody but they must hand over all informations collected, processed and analyzed to the Police for further actions.

Fourth, there should be a layered supervision over intelligence, including to give the rights for intelligence officer to reject to run an intelligence assignment if he/she assess that the task will potentially violate law and human rights.

Fifth, legal punishment should be applied to anybody leaking intelligence secrets.

Kontras also gives three recommendations for the Intelligence Bill deliberation. First, more discussions with civil society groups, such as regional civil societies and victims of bad intelligence practices such as in Aceh, Poso, and Papua. Second, the discussions shall refer to investigative reports and legal decisions such as Munir case, the report of the Commission of Truth and Friendship of the Republic of Indonesia and the Democratic Republic of Timor-Leste, investigation result from Indonesian Human Rights Commission and the National Human Rights Commission for Women. Third, the discussion should be in parallel with the discussion of National Security Bill and the Wiretapping Bill.

Intelligence Bill discussion has been going on for nine years, immediately after the tragedy of First Bali Bombing. Agus Gumiwang Kartasasmita, head of the House Working Committee of Intelligence Bill, meanwhile, expressed his optimism that the discussions will be completed before the end of DPR's hearing sessions in the coming weeks.

Agus also explained that the House and the Government have already agreed on several crucial points, including wiretapping authority with a number of conditions, BIN’s authority for coordinating institutions which have intelligence units, and for not allowing BIN to arrest and detain anybody
